S754 - UK implementation of the EMC Directive 2004/108/EC

Consultation on the UK implementation of the EMC Directive 2004/108/EC: Institution of Engineering and Technology comments to the Department of Trade and Industry (DTI).


Abstract There are two main issues concerning the DTI’s proposed transposition and implementation of the EMC Directive. Firstly, Access to Declaration of Conformity. Anybody should have the right to receive a copy of the EC declaration of conformity from the holder rather than relying on the goodwill of the manufacturer or his representative. Secondly, the definition of a ‘Fixed Installation’. This seems to be open to a wider and more encompassing interpretation than may have been intended. Industry and the citizen will suffer the costs of such shortcomings unless the scope of the document is narrowed.
